March 29, 1870.

Hon. Columbus Delano,

Commissioner Internal Revenue.

Sir:

I enclose herewith a copy of the brief of the United States in the suit, James B. Boylan, plaintiff in error, vs. The United States, in the Supreme Court of the United States, on error from the Circuit Court of the United States, for the Southern District of New York. Also an amendment to the agreed state of facts in this case, agreed upon by the counsel for Mr. Boylan, and the Attorney General in behalf of the United States, and filed with the record in the Supreme Court.

Yesterday the Supreme Court delivered an opinion affirming the judgment of the Circuit Court, which was in favor of the United States.

Very respectfully,

E. R. Hoar,

Attorney General.
