January 16, 1871. Hon. T. J. Bowers, San Rafael, California. Sir: Yours of the 14th ultimo was handed to me a day or two ago by the Hon. James A. Johnson. In reply I have to say that I do not feel at liberty to permit the use of my official title for the purpose of assailing a construction of law upon which the Executive Department uniformly acts, and which I hold to be correct. Very respectfully, A. T. Akerman, Attorney General.
