Sir:
I am directed by the Attorney General to transmit you herewith a copy of a letter from the Secretary of War, dated October 6th, covering a copy of a communication from Mr. S. R. Waters, late a deputy Prov. Marshal in the 4th Dist. of Maryland, relative to a suit brought against him by one Isaac Pearson, for alleged false imprisonment, &c.; & to say that you are hereby instructed, in accordance with the request of the Secretary of War, to take charge of, & conduct, the defence in the case.
The Attorney General desires, in connection with this suit, to refer you to the Habeas Corpus Act, app. March 3, 1863, & to the Amendment to that Act, app. May 11, 1866, (a copy of which is also enclosed.)
