December 10, 1870.
Hon Columbus Delano,
Secretary of the Interior.
Sir:
I am advised that E. A. Peyton, Esq., U. S. Marshal for the southern District of Mississippi, is in default to the Government for money collected by him under writs of fi. fa. and that a rule of the Circuit Court has been granted against him requiring payment of the money—and that he still fails to pay.
This information comes from the District Attorney of that District.
I respectfully recommend that if anything is due to the Marshal on account of the census, the amount be withheld until full inquiry into his accounts can be made.
Very respectfully, &c
A. T. Akerman, Attorney General
defaulting U. S. Marshal Miss.
