April 29, 1871. Mr. G. A. Porterfield, Charlestown, West Va. Sir: Though it is not the usage of this Department to give opinions on legal questions at the call of private citizens, I will say in answer to yours of the 27th inst. that I would advise that you do not act in any State office if the oath which you took to support the Constitution of The United States prior to your participation in the rebellion, was taken as an officer of the United States.
