June 6, 1867.

Delos Lake, Esq.

U. S. Attorney,

San Francisco, Cal.

Sir:

The Solicitor of the Treasury has referred to this Office your letter of April 29th 1867, in which you state the grounds of your suggestion of a nolle prosequi on the indictment against William Macy, for embezzlement.

The Attorney General directs me to say that he has no special instructions to give you in this matter—the case being left to your own responsibility & discretion.

Very respectfully,

M. F. Pleasants,

Ch. Cl'k.
