Hon. William Schouler.

Boston, Mass.

Sir:

I am in receipt of your letter of the 16th inst. calling my attention to the case of Hosmer v. the United States, pending in the Supreme Court of the United States, on appeal from the Court of Claims. Your letter will be transmitted to the Secretary of War, with a request that he will advise me whether he desires this case to be advanced on the calendar of the Supreme Court. It is the rule of this Office not to advance cases in which the particular Departments are interested, without the advice and consent of those Departments.
