Hon. John M. Schofield,

Secretary of War.

Sir:

I have the honor to acknowledge the receipt of your letter of the 2d instant, and enclosures, relating to a suit brought against Lieut. N. H. Chittenden, late Adjutant of the 4th Wisconsin Cavalry, for acts performed in the line of his duty.

In accordance with your request, the U. S. Attorney for the Southern District of New York has been instructed to take charge of the defence of the suit, and to report his action therein to your Department.
