Secretary of State.

Sir:

I have the honor to acknowledge the receipt of your letter of the 3d inst. relative to the proceedings instituted in Dakota Territory ag't William Barry, a U. S. soldier, for killing Capt. Speer, of the British army; and, in reply, to transmit you a copy of the instructions this day sent to Geo. H. Hand, Esq. U. S. Attorney for Dakota, on the subject.
