Sir:

In the suit entitled James B. Boylan pl'ff. in error, vs. The United States, No. 66 on the docket of the Supreme Court, for the present term, the counsel for the pl'ff in error proposed that the agreed statement of facts be amended by stipulation. I have considered this proposal, and have declined to enter into any such stipulation, and will thank you to communicate this to the Chief Justice, that the case may be considered and determined by the Court upon the record as it stands.
