April 12, 1870. Hon. C. Delano, Commissioner Internal Revenue. Sir: The Supreme Court yesterday delivered an opinion in Gates, assessor, plaintiff in error, vs. Osborn, et al. reversing the judgment of the Circuit Court, and ordering it to dismiss the suit for want of jurisdiction.
