December 10, 1870.
Hon. B. F. Potts,
Governor, &c,
Virginia City, Montana T.
Sir:
I have received your letter of the first instant, in relation to a case before the Supreme Court of the United States, involving the title to the offices of Territorial Auditor and Treasurer of Montana.
I will see that the Government of the Territory is represented before the Supreme Court. Without some examination, I shall not be able to say whether the matter falls within the sphere of the Attorney General's duties. If I should be satisfied that it does not, I will duly apprise you.
Very respectfully,
A. T. Akerman,
Attorney General.
