Dec. 26, 1871. R. McPhail Smith, Esq. U. S. Attorney, Nashville, Tenn. Sir: I think it proper that the nomination of your successor should be sent to the Senate at the termination of the recess on the 8th of January; and your resignation will be then considered as tendered, to take effect upon the confirmation of your successor. Very respectfully, A. T. Akerman, Attorney General.
